This clause was removed on October 31, 2018 pursuant to DFARS Case 2018-D041entitled "Repeal of DFARS Clause "Option for Supervision and Inspection Services" (DFARS Case 2018-D041)"

As prescribed in 236.609-70, use the clause at 252.236-7009, Option for Supervision and Inspection Services, in solicitations and contracts for architect-engineer services when— (i) The contract will be fixed price; and (ii) Supervision and inspection services by the architect-engineer may be required during construction. (2) Include the scope of such services in Appendix A of the contract.

Amends the DFARS to remove the DFARS clause 252.236-7009, Option for Supervision and Inspection Services, remove the associated clause prescription at DFARS 236.609-70(a)(1), and revise a cross reference in the introductory text to DFARS clause 252.236-7011. The clause is used in fixed-price solicitations and contracts for architect-engineering services when the architect may also be required to provide supervision and inspection services during construction; however, the need for architect-engineers to perform these services during construction is uncommon and, if necessary, should be included in the contract as an option that accurately describes the scope of services. As such, this DFARS clause is unnecessary and can be removed. The repeal of this DFARS provision supports a recommendation from the DoD Regulatory Reform Task Force established pursuant to E.O. 13777, "Enforcing the Regulatory Reform Agenda."

ORIGINAL TEXT

OPTION FOR SUPERVISION AND INSPECTION SERVICES (DEC 1991)

(a) The Government may—

(1) At its option, direct the Contractor to perform any part or all of the supervision and inspection services for the construction contract as provided under Appendix A of this contract; and

(2) Exercise its option, by written order, at any time prior to six months after satisfactory completion and acceptance of the work under this contract.

(b) Upon receipt of the Contracting Officer's written order, the Contractor shall proceed with the supervision and inspection services.
